Everything You Need to Know About OVWI/DUI Charges
What is an OVWI?
Under Indiana law, Operating a Vehicle While Intoxicated (oftentimes called an OVWI, DUI, or simply drunk driving) means that someone is accused of operating a vehicle with either a blood alcohol content above 0.08%, or with certain controlled substances (read: drugs) in their bloodstream.
What are the consequences if convicted?
Depending on the circumstances, a first-time offender might be looking at a Misdemeanor conviction and up to a year in jail. A repeat offender could be facing a Level 6 Felony and up to as much as two and a half years in jail. Not only that, any OVWI conviction can lead to a number of other unpleasant consequences, such as license suspension, financial costs, and more.
Can you fight back?
Every case is different and fact-specific, which is why it is so important to have an experienced attorney on your side to help prepare a strategy. There are a wide range of possible defenses available. Maybe the person wasn’t actually intoxicated, or they weren’t actually driving, or maybe there was a mistake with the chemical test. Additionally, a skilled attorney can help with getting limited driving privileges and minimizing the financial burden of a conviction.
